How Misloading or Overloading Commercial Trucks can Lead to Accidents

Proving Fault in Truck Overload or Misloading Cases

Getting evidence of cargo overload is not as simple as asking the trucking company for documents. If the truck was indeed overloaded, the trucking company has every reason to try to hide that violation of the law. You need to know what documents to demand and also where else you can get that information other than the trucking company itself.

Load balancing or load securing problems are another matter completely. Even if the truck was not overloaded, if the load was placed in the truck unevenly, or became uneven when cargo was unsecured, the shift in weight in the truck bed could severely imbalance the trailer. That could contribute to a jackknife-type accident.

Cargo that is not properly secured, or that becomes unsecured during transit, can fly off the truck bed and strike the cars and trucks behind it. On high speed expressways, flying debris can be deadly. A windshield does not offer adequate protection.
